Welcome to Kiddofy. Kiddofy is the app children use to safely enjoy online content and interact with friends. It is a community and service that helps children interact with friends and enjoy the Internet with access to approved content (e.g., Web pages) and trusted friends only. Parents use Kiddofy to safely share content with their children, allow trusted family and friends (including other children) to do the same, and moderate their kiddos' activity. With content shared by friends and collections curated by the team at Kiddofy, organized by age and topic, children never run out of fun and learning. Protecting their privacy and yours is a key part of achieving this goal. Kiddofy's approach to privacy is to be compliant, transparent, and to keep parents in control.
Kiddofy, LLC, ("Kiddofy", "our", "we", "us") provides to users in the United States our website, any related mobile or desktop apps, and our service of curating collections of age-rated content for kids which facilitates access to Internet websites (as a browser) and online sharing with others (collectively, our "Service"). Any terms used in this Privacy Policy not otherwise defined herein shall have the meaning provided in the Kiddofy Terms of Use (https://kiddofy.com/policy/toudef). By using the Service, any users of the Service are bound by and agree to the Terms of Use.
To use the Service, an "adult" may register and create a User Account. Registered adults who are also a parent or legal guardian (collectively, "parent") may allow their children to use the Service by adding them to their User Account. Children are not permitted to create an account of their own; accounts may only be created by an adult. Individuals can also access the Service as a "guest" but are not permitted to share content and links to content, rate content or otherwise communicate with Users and children in the Service. Personal information is not collected from individuals in guest mode.
This Privacy Policy explains how information is collected, used, shared, and protected by Kiddofy in connection with your or your child's use of our Service. For purposes of this Privacy Policy, all references to "parent" shall mean a parent or legal guardian, and all references to "child" or "children" shall mean anyone under the age of 18 years for whom you register as a User, including children under 13 years of age. Use of our Service may involve the collection of personal information from children but only those children's whose parents or guardians have permitted their child's use by adding them to their User Account or permitting another User to add them to their account. We obtain parental consent for such collection in accordance with the Children's Online Privacy Protection Act ("COPPA"), if and where required. By creating a Service account as a parent to enable a child's use of our Service, you are certifying that you are a parent or legal guardian of that child and are authorized to provide such consent to the child's use of the Service. Any other User adding a child to their account, you are certifying that you are legally authorized to add the child to your account (such as where the parent of the child has consented to this).
To provide our Service, we collect personal information (which means information that can be used to identify you individually and as defined under applicable law), in the following ways, depending on your use of the Service and your account settings. Without this information, we may not be able to provide our Service.
User activity history collected from adults, parents, and children:
When registered users of the service use various features of the Service, a record of those actions is retained for review by the user. This includes actions such as viewing, sharing, or rating content; inviting, beginning, or ending friend relationships; user profile updates; receipt of shared content or invitations; adding or removing a child or co-parent; etc. For children, the child, the child's parent, or the child's co-parent may review the child's activity history. Some actions taken by a parent or co-parent (collectively, the child's "parents") on behalf of their child are recorded in the child's activity history and are viewable by the child and their parents.
Identifiers, device information, log, and usage data:
All users of the service are assigned a persistent identifier used internally by the Service to uniquely identify each user. We collect IP addresses, certain device information, and usage data for purposes of operating the Service. Usage data may include information such as sign-in attempts, session times, content viewed, utilization of Service features, and Service performance. We do not use this information to provide any targeted ads or profile users for any marketing purposes. See the Cookie and Similar Technology section below for more information about automatically collected information from cookies.
To provide the Service, we may use cookies and similar technologies that automatically collect certain information from your browser or device when you visit our site, read our emails, or use our Service. We will not use cookies or similar technologies other than for the purposes stated in this Privacy Policy.

Providing the Service:
Elements of your user profile, including your Kiddofy Name, first and last name, profile picture, age, or gender (if provided) may be viewable by other users of the Service. Parents and co-parents may view and edit their child's full user profile and may view their children's Service activity histories. As a parent or co-parent, some of your actions regarding your child may appear in your child's activity history, which is viewable by the child and their other parent, if any. When you share content or content ratings, other users can see it was shared by you and view the content's profile, which you may have created or edited, your rating, or your rating comment. When you send an invitation or a request to another user, the user and their parents (in the case the user is a child) may view its contents and the above described elements of your profile. When you accept or reject an invitation or request, its sender may be notified of your decision. Other users may be notified by the Service when you take certain actions, such as updating your profile picture; sharing content or ratings; or sending, accepting, or rejecting an invitation or request.
Business transfers:
If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your information may be transferred to a successor or affiliate alone or as part of that transaction along with other assets. In such instances we will require that any entity follows the commitments in this privacy policy.

Your information may be shared with vendors, consultants and other service providers who need access to such information to carry out work on our behalf.

Aggregated or anonymized information:
We may share with third parties de-identified or aggregated information that does not reasonably identify any individual.
When a parent registers for our Service, we require the parent to provide certain information such as name and email address, as well as birth date for profile creation. By adding a child to the account, a parent consents to the collection and use of their child's personal information described in this Privacy Policy (i.e., profile picture and comments on content ratings, if enabled by parent).
At any time, a parent may refuse to allow further collection and use of a child's personal information by removing a child from the account or disallowing the child from providing a profile picture and/or commenting on ratings, as described in this Privacy Policy. Only a parent may update or change the parent's or child's information in the parent's Service account, or the parent may delete the account altogether, consistent with the Section "Account and Profile Information" below. Parents may review a child's personal information in their Service account at any time.
Kiddofy is committed to securing your personal information. To protect your information, we have implemented reasonable physical, organizational, and technological security measures, including encryption of your personal information when stored at rest and during transmission over the public Internet. However, the Internet cannot be guaranteed as fully secure, and we do not warrant the security of content or information you provide us. You are responsible for helping to protect the security of your own account credentials. As such, we encourage you to select a Kiddofy Name that does not reveal your identity and use care when providing your first name, last name, or profile pic and any personal information related to your child as part of your user profile or your child's access to the Service. We also encourage you to create and protect a strong password and never give out your account credentials.
The Service includes features that function like an Internet or Web browser, allowing you access to a limitless set of third party websites, services, applications, or other resources. Further, the Service may link to and may be linked by websites operated by other entities or individuals. This Privacy Policy does not apply to the practices of third parties that we do not own or control, including but not limited to third party websites, services, applications, or other resources ("Third Party Services") that you elect to access when using the Service as a browser or when following links from the Service to Third Party Services. When you visit a Third Party Service via the Service's browser features, by following a link from the Service, or when visiting a third party website and see a link to the Service, the privacy policy of that Third Party Service applies. We cannot control the activities of such third parties and you should consult the privacy policy of those Third Party Services to understand their privacy and other practices.
With your consent, we may send push notifications or alerts relating to activities on the Service to your mobile or desktop computer device. You can activate or deactivate these messages at any time by changing the notification settings on your device.
Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser. We do not currently support Do Not Track signals.
We will use, disclose, or retain your personal information for as long as the Service account is active, or for as long as necessary to fulfill the purposes for which that personal information was collected and as permitted or required by law.
Adults may update or correct information about them at any time by signing-in to their account. In the same way, parents may update or correct information about their children or remove them from their account. An account holder may remove their account from the Service. Note that we may retain certain information as required by law, in support of proper function of the Service, for security purposes, or for other legitimate business purposes. We may also retain information which has been de-identified or aggregated such that it can no longer reasonably identify a particular individual.

How to exercise your rights:
You may submit a request to exercise the rights listed above by emailing us at privacy@cust.kiddofy.com. These requests are generally free, and you may only make a consumer request twice within a twelve-month period. In your request, please include, (1) the full name you used to create your account; (2) the email you used to create your account; (3) a phone number we may contact you at if we need to securely verify your request; and (4) which right you are exercising.
As required under the CPRA, we take steps to verify your identity before responding to your request. We may require you to provide information sufficient to allow us to reasonably verify you are the person about whom we collected personal information or are a person registered with the California Secretary of State as an authorized representative to act on the requester's behalf. We may limit our response to your exercise of the above rights as permitted by applicable law. If you are the parent of a child under 13 years of age, you may also submit a request on behalf of your child.
Responding to requests:
We will confirm receipt of your request within 10 days from receipt and provide information about how we will process the request, our verification process, and when you can anticipate a response to the request.
We will use commercially reasonable efforts to honor your request within 45 days from receipt. If additional time is needed, we will notify you of the same, along with an explanation and anticipated timeline for the extension which shall not exceed 90 days from the date of receipt.

You may follow the same method for exercising rights as indicated in the "Additional Notice for California Consumers" section, except we may require you to provide information sufficient enough to allow us to reasonably verify you are the person about whom we collected personal information. We will not respond to anyone other than the person about whom we collected personal information, unless the requester is the parent of a child about whom we collected personal information.

Colorado and Virginia consumers under 13 years of age:
Processing of personal information of children in Colorado and Virginia who are under 13 years of age In Colorado, can only be done by first obtaining consent from the child's parent or lawful guardian as defined by COPPA. By adding a child to your user account, you are consenting to the collection of your child's information, if applicable and consistent with this Privacy Statement and our Terms of Use Agreement.
We may change this Privacy Statement at any time. If we decide to change this Privacy Statement in the future, we will post or provide an appropriate notice on the home page of the website or the app. If we make material changes to the statement, we will provide notice or obtain consent regarding such changes as may be required by law. The date on which the latest update was made is indicated at the top of this document.
